TERMS & CONDITIONS

for Magical Festival 2019 (the ‘Festival’)

Here’s the legal stuff! By purchasing Magical tickets (or agreeing to attend the Festival as a performer, crew member or volunteer), you agree to the following terms and conditions:

Magical Terms & Conditions of Sale ('Terms')

  • Your possession of a Magical ticket constitutes your acceptance of these Terms.
  • Tickets are sent as e-tickets via email, and cannot be refunded, re-issued or replaced, so don’t lose them!
  • Without a valid ticket, entry into the Festival site and campsite will not be permitted.
  • Magical reserves the right to change the location and date of the festival and shall provide reasonable notice should the date and location change.
  • Defaced or altered tickets will not be accepted.
  • Tickets will need to be displayed upon entry to the Festival in order to gain access. Save the trees and display these on a mobile device instead of printing the ticket!
  • Magical reserves the right to add, withdraw or substitute artists, activity or workshop providers and to vary the advertised programme and timings without being liable to pay any compensation whatsoever.
  • Photographic, video or audio reproduction of artists is prohibited.
  • The email address used at the time of purchase will be added to our mailing list. We send out emails to distribute important communications and information about the event. You may unsubscribe at any time by following the unsubscribe link at the bottom of any of our emails, but please be aware that if you do, you may miss important event-related communications.
  • Ticket holders consent to be included in official photographic, visual and audio media used to promote future events.
  • Parents are fully responsible for their children at all times and children must not be left unsupervised at any time during the Festival.
  • Children under the ages of 18 shall not be permitted within the main festival arena after 11pm. It is expected that children will generally by in the campsite area after 11pm.
  • We do not accept any liability for unaccompanied under 18s on any part of the site.
  • Children/teen tickets cannot be purchased separately – all under 18s must be accompanied by a legal guardian or Responsible Guardian. Unaccompanied children/teens will not be admitted.
  • Loco Parentis
    • In case of emergency we need to ensure that we are able to care for under 18s in their best interests and that may require us to take action immediately, for example medical treatment for a minor.
    • It is the lead ticket purchaser’s responsibility to ensure that a person is identified as the responsible guardian for all tickets purchased for those aged under 18 (Responsible Guardian). This is done by assigning a responsible adult for each under 18 ticket during the ticket purchasing process. The Responsible Guardian must:
      • a) be in ‘loco parentis’ for that child whilst at the Festival site. This means they are legally entitled to make decisions for that child, including in emergencies.
      • b) be the legal guardian of the child/teen, or have permission of the legal guardian of the child to act in loco parentis. If the latter, the Responsible Guardian must be aged 21 years or more.
      • c) be available throughout the Festival on the phone number provided during the ticket purchasing process.
  • You must agree to these conditions as part of the ticket purchasing process.
  • Weekend tickets include standard camping.
  • Day tickets do not include camping.
  • Day tickets are valid for the relevant event date from 09:00 – 02:30. Gates open at 09.00 and you must be offsite by 02:30.
  • There is no additional VAT to pay on the ticket prices stated.
  • Ticket prices are inclusive of one printed Magical 2019 festival programme per attendee.
  • Parking at the Festival is free of charge.
  • The Festival site is a beautiful natural area. Please help us keep it magical by cleaning up and using the rubbish / recycling facilities provided.
  • Ticket sales revenues will primarily be used to re-invest to next year’s festival, including infrastructure, health & safety and performers.
  • To run a successful event, ticket holders’ basic details are shared with ticket platform Citizen Ticket and cashless system provider Nutickets. Both these companies are GDPR compliant, and understand the importance in holding and using people’s personal information with safety, security and respect.

Magical Cancellation & Refund Policy

  • All tickets are non-refundable, including tickets purchased via the crowdfunding campaign, subject to Magical’s discretion to refund tickets. We cannot offer refunds on the basis of inclement weather.
  • In the event of cancellation due to unforeseen circumstances or events beyond the control of the organisers, a refund will not be available.
  • In the event of a national emergency (as defined by the MOD), the Festival will be cancelled and no refund will be available.

Magical Terms & Conditions of Entry

  • Admission to the site is at the ticket holder’s own risk. Magical and the site owner accepts no liability for any loss, injury or damage sustained to people or personal property within the site.
  • Vehicles and their contents are parked at the owner’s risk. We do not accept any responsibility for losses or thefts of any kind of property anywhere on the site including, without limitation, from vehicles, caravans, tents, trailers and campervans.
  • Gate opening and permitted entry times are:
    • Friday 2pm – 10pm
    • Saturday 9am – 10pm
    • Sunday 9am – 6pm.
  • Early / late arrivers will not be admitted, unless pre-arranged in advance. If you intend to arrive outside of these hours, please e-mail [email protected] with details.  
  • You must vacate the site by Monday 22 July 2019 at 2pm.
  • Wristbands are non-interchangeable and should not be removed or tampered with until after the Festival. We cannot replace lost wristbands. Wristbands will be checked throughout the course of the Festival. Failure to show a valid wristband upon request may result in your removal from the Festival site.
  • Ticket Holders who are (or appear to be) under 25 may be questioned upon entry and when trying to purchase alcohol, and should bring personal identification. The Magical bar operates a Challenge 25 policy and you may be refused service if you cannot prove your age when asked.
  • No spirits are permitted to be brought into the Festival site. The Festival site and campsite is a glass free zone. Any spirits in any container or mix shall be confiscated.
  • Maximum amount of alcohol per person (in non-glass containers), upon first entry to the Festival arena:
    • 5.5 litres (12 cans) of cider OR beer OR similar strength drink
    • OR 1.5 litres of wine
  • No alcohol is permitted to be brought into the Festival site upon re-entry.
  • Magical reserves the right to move people that are loitering, or consuming alcohol, in the carpark.
  • No animals (except guide dogs) are allowed on Festival site.
  • No glass whatsoever will be allowed onto the Festival site or campsite. Any glass will be confiscated on arrival.
  • No sound systems, generators or portable laser equipment are allowed on site unless by prior arrangement with Magical.
  • Open, uncontained fires are not allowed on the Festival site or on the campsite. Chinese lanterns, fireworks or smoke canisters are not allowed on the Festival site or campsite.
  • Any BBQs or contained fires must be raised off the ground and be located at least 5 metres away from a tent/structure.
  • Used BBQs must be disposed of in the designated BBQ bin.
  • If it is particularly hot and the ground is very dry, it may be necessary to ban the use of BBQs or contained fires.
  • Due to on-site sanitary and hygiene considerations, personal portable toilet units are not permitted to be brought onto the Festival site or camp site, and customers will be denied entry or ejected from the Festival should they breach this important condition of entry.
  • No illegal substances (or nitrous oxide) may be brought onto the Festival site or campsite, and illegal substances must not be used during the Festival. We have a zero tolerance drug policy. Any illegal substances found will lead to prosecution.
  • Security staff have the right to search anybody as a condition of entry to our event should there be a suspicion that prohibited items (or items that can be used in an illegal or offensive manner) are being brought onto the site. Anyone refusing to be searched on entry or during the Festival may be evicted from the site.
  • Accidents can be caused by uneven ground, slippery surfaces or hazardous conditions. All persons entering the Festival site do so at their own risk and acknowledge and agree that all due care and attention should be used whilst on site to avoid injury.
  • Security staff have the right to confiscate any prohibited items.
  • The Magical organisers reserve the right to refuse admission or instruct security staff to evict any ticket holder for behaviour likely to cause damage, injury, nuisance or annoyance (to other persons on site or neighbouring properties), or for failure to comply with site rules, licensing conditions or other reasonable requests of Magical, without reimbursement of the ticket price or other costs.
  • If you participate or attend the paint fight, you are strongly advised to wear eye protection and a dust mask to protect your eyes and your lungs. Those with allergies or sensitivities are advised not to participate in the paint fight. Whilst our paint is non-toxic, there is always a small risk of irritation, which cannot be avoided.
